Legal Disclaimer

The Huachuma Project exists to offer safe, grounded, and heart-centered spaces for
personal growth, emotional healing, and spiritual exploration through traditional and shamanic complementary therapies.
We are committed to upholding the highest standards of safety, ethics, and legal integrity, and we ask that all participants approach this work with sincerity, responsibility, and respect for the sacred.

The Huachuma Project is not a place of escape — it is a space of remembrance. We do not offer psychedelic tourism or spiritual performance. We hold sacred, grounded, and ethical containers for those who are ready to do the real work.

Our Commitment

The Huachuma Project does not provide medical advice, psychiatric care, or licensed
psychological treatment. We do not diagnose, treat, or attempt to cure any condition.

By participating, you confirm that:

  • You are in sound physical and mental health

  • You have no known contraindications as outlined in our preparation materials and intake form

  • You accept full responsibility for your experience, and have consulted a medical professional if needed

All participants are required to complete a Client Intake & Consent Form prior to the retreat.

We are committed to creating and protecting a sacred, safe, and trauma-informed space for
everyone present. Therefore,

We maintain a strict zero-tolerance policy for:

  • Aggressive, unsafe, or disruptive behaviour

  • Verbal abuse or threats

  • Violations of ceremonial space or safety protocols

  • Endangering oneself or others

If unsafe behaviour occurs, the disruptive individual will be removed from the site at the earliest opportunity.

No refunds will be issued in these cases. The Huachuma project reserves the right to involve local authorities or take reasonable measures to maintain safety where necessary.

Zero Tolerance Policy

The Huachuma Project is committed to operating in full alignment with all applicable laws of the Portuguese Republic, including, but not limited to, Law No. 15/93 of 22 January (as amended), which governs the legal framework surrounding narcotic and psychotropic substances.

By maintaining the boundaries stated on this page, The Huachuma Project ensures that its operations remain fully compliant with the spirit and letter of Portuguese law, while upholding the highest ethical standards for safety, transparency, and respect for the land, the plants, and the individuals who choose to participate.

Legal Position & Compliance Statement

Under current Portuguese law, the cultivation and possession of Echinopsis pachanoi (commonly known as San Pedro cactus), which naturally contains the alkaloid mescaline, is not prohibited when the plant is maintained in its natural, unprocessed state.

The presence of naturally occurring mescaline within the cactus does not, in and of itself, constitute an offence under Law 15/93, provided there is no evidence of extraction, concentration, manufacture, trafficking, or commercial promotion for the purposes of human consumption.

All San Pedro cactus plants present at The Huachuma Project are cultivated and maintained strictly for ornamental, botanical, and educational purposes, consistent with their legal status in Portugal.

Legal Status in Portugal

In accordance with Articles 40 and 41 of Law 15/93, the following activities are expressly prohibited and are not undertaken by The Huachuma Project:

The extraction, isolation, or concentration of mescaline or any other controlled substance from San Pedro or any other plant or source.

The sale, distribution, gifting, exchange, or promotion of San Pedro, Kambo, or any preparation containing controlled substances.

The administration or provision of any psychoactive substance to another person in any form.

The advertising or public promotion of any event for the purpose of facilitating the use of controlled substances.

Prohibited Activities

Participation in any retreat hosted by The Huachuma Project is offered exclusively within a private, closed-group, by-invitation-only context, with attendance limited to confirmed guests who have completed our intake and consent process.

Contributions made by participants cover only the costs of accommodation, meals, venue access, preparation and integration resources, and guided facilitation in the context of personal development, cultural education, and spiritual exploration.

No payment is accepted, either directly or indirectly, for the provision of San Pedro, Kambo, or any other plant, animal, or synthetic material that may contain controlled substances.

Nature of Retreat Participation

If an individual participant chooses, entirely of their own free will, to engage with San Pedro or Kambo during their private time at a retreat, such engagement is self-initiated and self-administered.

The Huachuma Project does not prepare, supply, administer, or encourage the ingestion of any psychoactive substance.

Any interaction with these plants is considered a private act of personal autonomy, undertaken by the participant in accordance with their own understanding, responsibility, and informed consent.

Voluntary, Self-Directed Engagement

The Huachuma Project exists for the preservation and sharing of traditional cultural knowledge, safe personal development practices, and ethical shamanic complementary work within the boundaries of Portuguese law.

All activities, discussions, and educational materials are provided for the purposes of personal insight, cultural preservation, and botanical education, and are not intended as encouragement or facilitation of illegal activity.
